The difficulty is that most injunctions contain terms that prohibit parents from interacting with each other and being close to them. Most orders also prohibit parties from using “lay” third parties as messengers. Even if a prescription doesn`t say a parent can`t have contact with a child, it can often be the practical result. If you are unable to go to court because your safety is in danger or you are in an urgent or serious risk, it is recommended that you call the police immediately. The police have the option to issue an injunction, which can give you enough time to appear in court to file an application for an injunction that, once issued, will be in effect for a longer period of time. Daniel: If you have been served with a preliminary injunction against violence, it is important to remember that you must comply with the conditions, as severe penalties apply if you violate the order. And you should never contact the other party – even if they contact you. All interactions permitted under a family court order are legal, even if they violate the terms of a preliminary injunction. If the family court order is not a parenting order, the injunction will not be set aside.

For example, a family court order dealing with financial matters will not prevail over an injunction. When an injunction is issued on a final basis, it is usually imposed for a period of 2 years. In some situations, an adult may request that other adults or children be added to their own order. But as a general rule, the person who has suffered the violence or abuse should apply for their own injunction, and they should separately present their own evidence to the judge. Children are not allowed to testify in preliminary orders unless the case is heard in the juvenile court or there are exceptional circumstances.

If your initial application is not rejected, your case will be registered in due course for a final hearing, which is usually between 3 and 12 months later, depending on court availability. If an injunction was granted on your original application, the order may remain in effect for the duration of the waiting period until the final hearing of the order.
